Rug'd — Terms of Service
1. Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of the Rug'd game, websites, and related services (together, the "Service"), operated by Michael Cooney, an individual operating Rug'd as a sole proprietor ("Rug'd," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service is currently a closed prototype in active testing. It is provided for evaluation purposes, may be incomplete or unstable, and may change or be discontinued at any time.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service you represent that you meet this requirement and that you are able to form a binding contract. Access to the closed playtest is by invitation/approval only; we may grant or revoke access at our discretion.
3. Your account
You are responsible for the activity that happens under your account and for keeping your sign-in credentials secure. Authentication is handled by our provider (Clerk). Notify us promptly if you believe your account has been accessed without your authorization. You may not share, sell, or transfer your account.
4. Acceptable use
When using the Service, you agree not to:
- break any applicable law or regulation, or use the Service for any unlawful purpose;
- cheat, exploit bugs for unfair advantage, use unauthorized automation/bots, or interfere with normal gameplay for others;
- attempt to gain unauthorized access to the Service, other accounts, or our systems, or probe, scan, or test the vulnerability of our infrastructure without our written permission;
- disrupt or overload the Service (including denial-of-service attempts, spam, or abusive traffic);
- harass, threaten, defame, or abuse other players or our team;
- upload or transmit content that is illegal, infringing, malicious (e.g. malware), or that you don't have the right to share;
- reverse engineer, decompile, or attempt to extract source code except to the extent the law expressly permits;
- misrepresent your identity or impersonate others.
We may suspend or remove access for conduct that violates these rules, with or without notice, to protect the Service and its users.
5. The in-game currency ($tRUGD) and game items — important
Rug'd is a satirical, crypto-themed game. It includes a fictional in-game token called $tRUGD and other in-game items, scores, and rewards. You acknowledge and agree that:
- $tRUGD and all in-game items have no monetary or real-world value. They cannot be purchased with real money, cashed out, redeemed, exchanged for currency, or transferred outside the game.
- $tRUGD is not a cryptocurrency, token offering, security, commodity, investment, financial instrument, or a promise of any future product, airdrop, or value.
- Nothing in the Service is financial, investment, legal, or tax advice. The game's crypto theming and satire are for entertainment and are not a representation about any real asset or market.
- In-game balances, scores, and progression exist only within the test environment and may be reset, altered, or deleted at any time, including when the test concludes. You should not expect any in-game value to persist.
If we introduce any feature with real-world value in the future, it will be governed by separate, clearly disclosed terms — these Terms do not create any such feature.
6. Intellectual property
The Service, including its game design, mechanics, artwork, characters, text, logos, "Rug'd" branding, and software, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial gameplay during the test. You may not copy, distribute, modify, or create derivative works from the Service except as expressly permitted.
Your feedback
If you send us feedback, suggestions, or ideas about the Service, you grant us a perpetual, worldwide, royalty-free right to use them to operate and improve Rug'd without obligation or compensation to you. You confirm your feedback does not include anyone else's confidential or proprietary information.
7. Third-party services
The Service relies on third-party providers (such as Clerk, Supabase, Railway, Vercel, Loops, and Anthropic) and may link to third-party sites (such as Discord). We are not responsible for the content, policies, or practices of third parties. Your use of those services is governed by their own terms and privacy policies.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains what data we collect and how we handle it. By using the Service you acknowledge the Privacy Policy.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any data or in-game progress will be preserved. Because the Service is a prototype, you use it at your own risk.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUG'D AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. Our total liability for any claim relating to the Service will not exceed one hundred US dollars (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the smallest extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless Rug'd and its operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
12. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, including if you breach these Terms, if required for security or legal reasons, or when the closed test ends. You may stop using the Service and request account deletion at any time. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
13. Changes to the Service and to these Terms
We may modify, suspend, or discontinue any part of the Service at any time, particularly given its prototype status. We may also update these Terms; when we do, we will update the "Last updated" date and, where changes are material, take reasonable steps to notify testers. Continued use after changes take effect means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Florida, except where applicable consumer-protection law entitles you to bring proceedings in your local courts. Nothing in these Terms removes any mandatory statutory rights you have under the laws of your country of residence.
15. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
- Severability. If any provision is found unenforceable, the rest remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms; we may assign them in connection with a transfer of the project.
